Terms of Sale

These are the terms you agree to when you order from us. We have kept them plain, because a term nobody can read is not much of a term.

Who you are buying from

Miss Confection LLC, a bakery in Loomis, California, registered with the U.S. Food and Drug Administration as a food facility (registration number 16134450266). Registration means the kitchen is on file with the FDA. It is not an FDA approval or endorsement.

Orders and minimums

Paying

Checkout takes debit and credit cards and Venmo through PayPal. Venmo and Zelle direct, and orders of 50 or more, go through Orders@missconfection.us or 844-YUM-POPS. You are charged when you place the order.

Shipping and when it goes out

We bake to order and ship every Monday and Tuesday, by USPS Priority Mail or UPS/FedEx 2 day air. Shipping is a flat rate by pack size, listed on the packaging and shipping page. Warm weather packing is included, with no summer surcharge.

If we cannot ship your box within 30 days of your order, we will email you. You can wait for the new date or cancel for a full refund. If you do not reply to that email, we cancel the order and refund you.

When it arrives

Once the carrier has your box, delivery timing is in their hands. Please plan for someone to bring the box inside the day it lands. These are fresh baked goods, not shelf stable candy. Put them in the refrigerator when you open the box, and enjoy them within about 10 days. Let them sit out for about 15 minutes before you eat them.

Food and allergies

Every box is labeled with the flavor, the full ingredient list, the allergens and the net weight. Our pops are made in a kitchen that handles wheat, eggs, milk, soy, peanuts and tree nuts. We cannot promise that any pop is free of a specific allergen. If an allergy is serious, please call or email us before you order, and please read the label on the box when it arrives.

We do not make health, diet or nutrition claims about our pops. They are dessert.

Refunds

See the refund policy. It is short.

Photos, names and brands

The photographs, text, logo and artwork on this site belong to Miss Confection LLC. Some flavors are made with branded ingredients, and those brands belong to their owners. We are not connected to those companies. We just bake with their products.

The limits of what we owe you

If something goes wrong with an order, what we owe you is capped at what you paid for that order. We are not responsible for indirect losses, for example a party that did not go to plan. Nothing here takes away rights you have under California law that cannot be waived.

Where disputes go

These terms are governed by the law of the State of California, and any dispute belongs in the state or federal courts serving Placer County, California.
